Who this notice covers
Treat this page as a working template written in everyday language for ESA Letter TX. A licensed attorney has not reviewed it yet, and one should before the business relies on it. Wherever you see [confirm], the owner still has to verify or supply a business detail.
ESA Letter TX runs the website you use to book. The clinical services themselves come from the treating clinicians and the telehealth platform that hosts the visit and your patient portal. They create and maintain your health records and carry the HIPAA duty to protect them. Your clinical provider's complete Notice of Privacy Practices is available on request and inside the patient portal [confirm where the full notice is posted]. Where this summary and the complete notice disagree, follow the complete notice.
Everyday uses of your information
- Treatment: the clinician reads your intake, evaluates you and, if appropriate, writes your letter.
- Payment: billing for a letter once it's written.
- Health care operations: scheduling, quality checks and staff training.
- Appointment reminders and messages about your care.
Sharing without your signature
HIPAA allows certain limited disclosures without written authorization. Examples: when a law mandates it, to prevent imminent danger to someone's safety, for public health reporting, to answer a court order or valid subpoena, and for government health oversight.
Sharing that needs your signature
Most other disclosures need your signed authorization, including most uses of psychotherapy notes, marketing and any sale of health data. A landlord, school or employer sees your letter only because you decide to hand it over; your clinician won't send records to them unless you authorize it. You can withdraw an authorization in writing later, though that won't undo disclosures already made.
Your rights
- Get your health record in digital or printed form.
- Request a correction if something in it is inaccurate or missing.
- Ask to be contacted a particular way, such as at a specific email address.
- Request limits on use or sharing. The provider can sometimes decline, but if you paid entirely out of pocket, it must honor a request not to tell your health plan.
- Get a list of certain disclosures from the previous six years.
- Request a paper copy of the complete notice.
- Let a personal representative, for example a court-appointed guardian, make these requests for you.
- Be told about a breach involving your unsecured health information.
Questions and complaints
To use any right listed here or ask a privacy question, email support@esalettertx.com and we'll route it to the clinical provider's privacy contact [confirm privacy officer contact]. If you think your privacy was violated, you may complain to the provider or to HHS, the federal health department, through its civil rights office. Nobody may retaliate against you for complaining.
This notice can be revised, and a revision will cover records already on file. Check the effective date to see which version is current.
